These Terms and Conditions apply to the services offered on the website www.propracconsultants.com operated by PROPRAC Consultants Pty Ltd (ABN 88 168 202 757).

We have taken proper care and precautions to ensure that the information we provide on this Website is accurate.  However, we cannot guarantee, nor do we accept any legal liability arising from or connected to, the accuracy, reliability, currency, or completeness of anything contained on this Website or on any linked site.

The information contained on this Website should not take the place of professional advice.

The Website is made available for your use on your acceptance and compliance with these terms and conditions.  By using this Website, you are agreeing to these terms and conditions. You agree that you will use this website in accordance with all applicable local, state, national and international laws, rules, and regulations.

We reserve the right to withdraw or amend this Website and any service or material we provide on the Website in our sole discretion without notice. We will not be liable if for any reason all or any part of the Website is unavailable at any time or for any period. 5. Indemnification for loss or damage

You agree to indemnify PROPRAC Consultants Pty Ltd and hold Us harmless from and against any and all liabilities or expenses arising from or in any way related to your use of this Website or the Services or information offered on this Website, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and solicitor’s fees of every kind and nature incurred by you or any third parties through you.

This Website may contain links that direct you outside of this Website.  These links are provided for your convenience and are not an express or implied indication that we endorse or approve of the linked Website, its contents or any associated website, product, or service. We accept no liability for loss or damage arising out of or in connection to your use of these sites.

You may link to our articles or home page.  However, you should not provide a link which suggests any association, approval, or endorsement on our part in respect to your website, unless we have expressly agreed in writing.  We may withdraw our consent to you linking to our site at any time by notice to you.

7. Limitation of Liability

We take no responsibility for the accuracy of any of the content or statements contained on this Website or in relation to our Services.  Statements made are by way of general comment only and you should satisfy yourself as to their accuracy.  Further, all our Services are provided without a warranty except for any warranties provided by law.  We are not liable for any damages whatsoever, incurred because of or relating to the use of the Website or our Services.

We retain the right to bring proceedings against you for breach of these Terms and Conditions, in your country of residence or any other appropriate country or jurisdiction.

8. Venue and Course Material

For class-room delivery, training/course shall be as outlined and shall include: (a) refreshments each day (b) a participant guide, where applicable and (c) a Certificate of Attendance / Certificate of Completion indicating the total number of hours of training to enable delegates to claim PDUs through PMI (Project Management Institute), where applicable.

PROPRAC Consultants Pty Ltd endeavours to use only high-quality venues to conduct its training. Published venues may change and are subject to confirmation upon registration. We reserve the right to change the venue and will advise the customer as soon as the change is known. PROPRAC Consultants Pty Ltd will not be liable for any out-of-pocket expenses due to cancellation or any other changes to the venue.

For online/virtual delivery, training/course shall be as outlined and shall include: a participant guide, where applicable and (b) a Certificate of Attendance / Certificate of Completion indicating the total number of hours of training to enable delegates to claim PDUs through PMI (Project Management Institute), where applicable.

Contents of course timetables are intended for general guidance only. Any typographical error including pricing or omission in any website, sales literature, administrative documentation, course materials, invoice, or other documents shall be liable to correction without any liability on the part of PROPRAC Consultants Pty Ltd.

PROPRAC Consultants Pty Ltd reserves the right to change any part of a published course if this is caused by circumstances beyond our control. PROPRAC Consultants Pty Ltd reserve the right to cancel or reschedule any course and will advise the customer as soon as the change is known. We will use all reasonable endeavours to avoid changes of this nature.  For any courses which are rescheduled due to unforeseen circumstances (such as trainer sickness/course low fill, natural disaster, etc.) every endeavour will be made to provide a replacement training or to reschedule the course and we will offer delegates as many options as possible to complete their training programme.

9. Payment

Registrations can be made by through the website or emailing to training@propracconsultants.com,  however, a place cannot be guaranteed unless a full payment is received at least 21 days prior to the commencement of the training.  Payments can be made by PayPal or through direct bank deposit. We do not accept credit card payments, nor we store credit card information. We may be able to invoice you if required. Please email your request to training@propracconsultants.com.

Each session has limited seats and is only allocated on a first to pay basis.

The course fee must be paid at least 21 days prior to the commencement of the course. A tax invoice for the payment shall be sent to the delegate upon receipt of payment.

Registration confirmation will be emailed to the participant’s nominated email address upon receipt of payment in full. If email confirmation has not been received by the delegate within 2 days of full payment, please immediately contact PROPRAC Consultants Pty Ltd by emailing training@propracconsultants.com (attached copy of your payment receipt) or calling +61 2 1300 733 618.

Delegates must bring a copy of the confirmation of registration email and a photo ID to the session. Delegates without these documents may be refused admission to the session.

Course enrolment is strictly non-transferable.

10. Cancellation

Unless written cancellation is received at least 21 working days prior to the start date of the course, the full fees including GST (if applicable) are payable in full and non-refundable. All cancellations must be advised in writing by the participant by sending an email to training@propracconsultants.com.

Should a course booking be made less than 21 working days prior to the course start date, the above cancellation terms still apply, and fees are payable in full and non-refundable.

If the cancellation is made more than 21 working days in advance of the course a cancellation admin fee of $75 +GST per delegate will be payable upon cancellation.

11. Re-scheduling Courses and Exams

Re-scheduling of the courses or exam less than 21 calendar days before the course start date is not permitted.

If the Re-scheduling is made more than 21 calendar days in advance of the exam, a Re-scheduling admin fee of $100 + GST (if applicable) per delegate will be payable upon Re-scheduling.

12. Refund

When a refund is issued to the Customer by The PROPRAC ConsultantsPty Ltd the refund may take up to 20 business days to be processed. Refunds will be processed using the same payment method that the original payment was made. Deposits surcharge and banking fees are non-refundable.

PROPRAC Consultants Pty Ltd will not be liable for any fluctuation in exchange rates or bank charges for overseas refund transactions.

13. Non-Attendance

Non-attendance of any course for any reason whatsoever is deemed to be a cancellation with no notice and payment is due in full and is non-refundable.

14. E-Learning, Online Learning

Course enrolment, fees and logon credentials are strictly non-transferable and non-refundable.

Fair Usage Policy applies to access to study materials. PROPRAC Consultants Pty Ltd reserves the right to restrict access based on operational requirements including bandwidth consumption to ensure fair access to all learners. Access to e-learning/online products is granted for a 60-day period or as advertised at the time of the course booking from date of purchase. Extensions can be granted upon request. If you require an extension, please contact training@propracconsultants.com at least 14 days prior to the expiry date to obtain an extension quotation.

15. Intellectual Property and Copyrights

The website and all the products and services of the PROPRAC Consultants Pty Ltd without limitation are protected by international copyrights, trademarks and subject to intellectual property rights. Therefore, all intellectual property belongs to the PROPRAC Consultants Pty Ltd, its affiliates or suppliers.

We hold the copyright to the content of this Website, including all uploaded files, layout design, data, graphics, articles, file content, codes, news, tutorials, videos, reviews, forum posts and databases contained on the Website or in connection with the Services. You must not use or replicate our copyright material other than as permitted by law.  Specifically, you must not use or replicate our copyright material for commercial purposes unless expressly agreed to by Us, in which case we may require you to sign a Licence Agreement.

All intellectual property rights for all training/course materials shall remain the property of The PROPRAC Consultants Pty Ltd. The Customer agrees not to reproduce, sell, hire, lend or copy the course materials or use them. PROPRAC Consultants Pty Ltd warrants that it will not knowingly include any copyrighted material in its course materials without licence or consent.

PROPRAC Consultants Pty Ltd does not accept responsibility for intellectual property used during any training provided which does not show an affiliation to the PROPRAC Consultants Pty Ltd. Any intellectual property used in a training course, including the course itself is subject to intellectual property rights.

16. Warranty & Liability

PROPRAC Consultants Pty Ltdliability for loss and damage shall be limited to a claim for damages. The maximum aggregate liability will be the charges for the course out of which the loss or damage has arisen.

PROPRAC Consultants Pty Ltd will not accept any liability for death or personal injury that incurs during our training courses.

PROPRAC Consultants Pty Ltd will not be liable for any indirect, special or consequential loss (including loss of anticipated profit or data), howsoever arising, even if it has been advised of such potential loss.

PROPRAC Consultants Pty Ltd will not be responsible for any damage resulting from any computer viruses, malware, or any other malicious software arising from software installed on customer computer systems.

17. ForceMajeure

PROPRAC Consultants Pty Ltd shall not be in breach of this contract if the provision of services are delayed or cancelled or reduced through any circumstances beyond its reasonable control including acts of God (including but not limited to, fire, flood, earthquake, storm, snow, hurricane, pandemic, or other natural disasters) sickness, war, invasion, the act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, nationalisation, government sanction, blockage, embargo, labour dispute, strike, lockout or interruption or failure of electricity or telephone service. Delegates must ensure that they can attend the training courses which they are scheduled to attend. PROPRAC Consultants Pty Ltd will not be held liable, financially or actually, for their non-attendance, whatsoever the reason may be.

18. Information Collection

Use of information you have provided us with, or that we have collected and retained relating to your use of the Website and/or our Services, is governed by our Privacy Policy.  By using this Website and the Services associated with this Website, you are agreeing to the Privacy Policy.  To view our Privacy Policy and read more about why we collect personal information from you and how we use that information, Add link to the privacy policy.

19. Material provided to the website

PROPRAC Consultants Pty Ltd does not claim ownership of the materials you provide to the Website (including feedback and suggestions), post, videos, photographs, comments, etc (collectively ‘Submission’). However, by posting, uploading, providing Submission you are granting Us, and our partner’s permission to use your Submission in connection with the operation and marketing without limitation, the rights to copy, distribute, transmit, publicly display, publicly perform, reproduce, edit, translate, and reformat your Submission; and to publish your name in connection with your Submission.

No compensation will be paid with respect to the use of your Submission, as provided herein. PROPRAC Consultants Pty Ltd is under no obligation to post or use any Submission you may provide and may remove any Submission at any time at PROPRAC Consultants’ sole discretion.

By posting, uploading, inputting, providing, or submitting your Submission you warrant and represent that you own or otherwise control all of the rights to your Submission as described in this section including, without limitation, all the rights necessary for you to provide, post, upload, input or submit the Submissions.

20. Use of images, photographs, and videos for marketing

We may collect images, photographs, or record videos, etc. of the participants and attendees during training, seminars, workshop, which PROPRAC Consultants Pty Ltd or our partners, affiliates may use for marketing purposes on the website, social media channels (Facebook, LinkedIn, Instagram, Tweeter, etc.), brochures, marketing flyers and other marketing channels.

No compensation will be paid with respect to the use of this information by PROPRAC Consultants Pty Ltd.

By accepting these Terms and Conditions, you are granting PROPRAC Consultants Pty Ltd permission to use your image, photo, video for marketing purpose. You must advise us in writing by emailing training@propracconsultants.com before the start of the event if you do not wish for your image, photograph, or video to be included in marketing material.

21. Money Back Guarantee 

 Any Money Back Guarantee that we offer on our products will be subject to eligibility condition associated with the offer and will be applicable to that product only.

Money Back Guarantee offered on courses (that require you to sit for formal exam conducted by external body, e.g., PMI, Scrum Alliance, AXELOS, etc.) is only applicable if you score more than 75% on PRORPAC practice exam at the end of the training.

You must also take sit for the formal exam within sixty (60) calendar days of completing training conducted by PROPRAC Consultants or its partner, if applicable.

No money will be reimbursed if you pass the exam.

Candidates will not be reimbursed for any claim if above conditions are not met.

22. Confidentiality

All personal information you give us will be dealt with in a confidential manner in accordance with our Privacy Policy.  However, due to circumstances outside of our control, we cannot guarantee that all aspects of your use of this Website will be confidential due to the potential ability of third parties to intercept and access such information.

23. Governing Law

These terms and conditions are governed by and construed in accordance with the laws of New South Wales, Australia.  Any disputes concerning this website are to be resolved by the courts having jurisdiction in New South Wales, Australia.
